1. Who we are and what this is
Gay Fans Guide (“Gay Fans Guide,” “we,” “us,” or “our“) operates the website at https://gayfansguide.com (the “Site“). The Site publishes editorial reviews, commentary, and curated information about adult content creators, including creators on third-party platforms such as OnlyFans. All reviews are written by our editorial staff. The Site does not host, display, or distribute pornographic images or videos; it contains written reviews that may include explicit language.
Editorial reviews are opinions protected by law, and that you are not liable for the third-party content hosted on OnlyFans itself.
By accessing or using the Site, creating an account, or subscribing, you agree to these Terms of Service (“Terms“). If you do not agree, do not use the Site.
2. Adults only (18+ / 21+ where required)
The Site is intended solely for adults. You represent and warrant that you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and that it is legal for you to access adult-oriented content where you live. See our separate 18+ / Age Policy and our age-gate on entry. We reserve the right to refuse or terminate access to anyone we reasonably believe to be a minor.
3. Accounts
Some areas require an account. You agree to provide accurate information, keep your credentials confidential, and remain responsible for all activity under your account. Notify us immediately at support@gayfansguide.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
4. Subscriptions and membership tiers
The Site offers a Free tier and one or more Paid subscription tiers. Paid tiers unlock restricted content, editorial features, and/or a subscriber newsletter as described at the point of purchase.
- Billing. Paid subscriptions are billed on a recurring basis (e.g., monthly or annually) through our third-party payment processor, TBD. By subscribing, you authorize us and our processor to charge your payment method on a recurring basis until you cancel.
- Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. We will disclose renewal terms clearly before you purchase.
- Price changes. We may change subscription prices; we will give you advance notice and the change will apply to the next billing cycle.
- Cancellation and refunds. See our separate Refund & Cancellation Policy, which is incorporated into these Terms.
5. Editorial independence, affiliate links, and disclosures
Our reviews reflect our staff’s editorial judgment. Our editorial reviews are opinions protected by law, and that you are not liable for the third-party content hosted on OnlyFans itself. The Site may contain affiliate links: if you click certain links to third-party platforms (such as OnlyFans creator pages) and take an action, we may earn a commission at no additional cost to you. Consistent with FTC guidance, we disclose these relationships. Affiliate relationships do not dictate the substance of our reviews.
6. Relationship to third-party platforms and creators
Gay Fans Guide is an independent review publication. We are not affiliated with, endorsed by, or sponsored by OnlyFans or any creator we review, unless expressly stated. Trademarks and names belong to their respective owners and are used for identification and commentary (nominative fair use). We do not control third-party sites and are not responsible for their content, terms, pricing, availability, or conduct. Your dealings with any third-party platform or creator are solely between you and them.
7. Acceptable use
You agree not to:
- use the Site if you are under 18 (or the age of majority where you live);
- copy, scrape, republish, resell, or redistribute our reviews or other content without written permission;
- share, resell, or provide access to paid content or your account credentials to non-subscribers;
- attempt to bypass the age gate, paywall, or any access control;
- upload malware, attempt to breach security, or interfere with the Site’s operation;
- harass, threaten, defame, or violate the rights of our staff, other users, or the creators we cover;
- use the Site for any unlawful purpose or in violation of these Terms.
8. Intellectual property
All reviews, text, graphics, logos, and design on the Site are owned by or licensed to Gay Fans Guide and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to access and view content for your own non-commercial use consistent with your subscription tier. All rights not expressly granted are reserved.
9. User-submitted content (if applicable)
If we enable comments, tips, or other submissions, you grant us a worldwide, royalty-free, perpetual license to use, display, and adapt what you submit in connection with the Site. You are responsible for your submissions and represent that you have the right to share them. We may remove any submission at our discretion.
10. DMCA / copyright complaints
If you believe content on the Site infringes your copyright, send a notice to our designated agent at support@gayfansguide.com with the information required under the DMCA (identification of the work, the material, your contact details, a good-faith statement, a statement under penalty of perjury, and your signature). We will respond to valid notices, including by removing infringing material and, where appropriate, terminating repeat infringers.
11. Disclaimers
The Site and all content are provided “as is” and “as available.” Reviews reflect subjective editorial opinion as of the date written and may become outdated. We do not warrant that any creator, platform, price, or offering described will match your experience. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, Gay Fans Guide and its owners, staff, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the [12] months before the claim, or (b) USD $100.
13. Indemnification
You agree to indemnify and hold harmless Gay Fans Guide from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Site, your submissions, or your violation of these Terms or applicable law.
14. Termination
We may suspend or terminate your access at any time for violation of these Terms or for any lawful reason. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitation of liability, indemnification, governing law) will survive.
15. GOVERNING LAW, DISPUTE RESOLUTION, AND CLASS ACTION WAIVER
A. Governing Law. You agree that this Agreement, your use of the Website, and any dispute arising between you and the Company will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its choice of law or conflict of law principles.
B. Informal Dispute Resolution. Before filing any formal claim, you agree to try to resolve the dispute informally. You must send a written notice describing your claim to [Your Legal Email Address]. If we cannot resolve the dispute within thirty (30) days of receiving your notice, either party may pursue formal resolution through binding arbitration as detailed below.
C. Mandatory Binding Arbitration. YOU AND THE COMPANY AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY. All disputes, claims, or controversies arising out of or relating to these Terms, the Website, or the content provided herein shall be settled exclusively by final and binding arbitration. The arbitration will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
- Venue: The arbitration shall take place remotely via video conference, or in Wilmington, Delaware, unless the AAA rules require otherwise.
- Costs: Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules.
D. Class Action and Jury Trial Waiver. YOU AND THE COMPANY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. Neither you nor the Company will seek to have any dispute heard as a class action, collective action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding will be combined with another without the prior written consent of all parties to all affected arbitrations or proceedings.
E. Limitation on Time to File Claims. Any cause of action or claim you may have arising out of or relating to these terms or the website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and, where required, notify subscribers. Continued use after changes take effect constitutes acceptance.
